1claw Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms," "Agreement") govern your access to and use of the 1claw platform, API, dashboard, MCP server, SDK, and all related services (collectively, the "Service") operated by 1claw ("we," "us," or "our"), accessible at https://1claw.xyz and https://docs.1claw.xyz.

By accessing or using the Service, you agree to be bound by these Terms and accept all legal consequences. If you do not agree to these Terms, in whole or in part, please do not use the Service. These Terms apply to all visitors, users, developers, and organizations that access or use the Service.

2. Description of Service

1claw is a secrets management platform purpose-built for human operators and AI agents. The Service includes:

  • A secure vault system backed by Hardware Security Modules (HSM) for storing API keys, tokens, credentials, and other secrets
  • A REST API (api.1claw.xyz) for programmatic secret storage and retrieval
  • A Model Context Protocol (MCP) server (mcp.1claw.xyz) enabling native integration with AI assistants such as Claude, Cursor, and GPT
  • A web dashboard (1claw.xyz) for managing vaults, agents, policies, and audit logs
  • An SDK (@1claw/sdk) and supporting developer tooling
  • Policy-based access controls, short-lived JWTs, and a full append-only audit trail

1claw reserves the right to modify or discontinue any feature or functionality of the Service at any time. All rights, title, and interest in the Service remain exclusively with 1claw.

3. Accounts

To use the Service, you must create an account. You agree to provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of these Terms.

You are responsible for safeguarding your account password, API keys (1ck_ for personal use, ocv_ for agents), and any other credentials associated with your account. You agree not to share your credentials with unauthorized third parties, and you must notify us immediately at ops@1claw.xyz upon becoming aware of any unauthorized access to your account.

You are solely responsible for all activity that occurs under your account, including activity initiated by AI agents that you register and authorize.

4. Subscriptions and Billing

Certain features of the Service are available under a free tier (1,000 API requests per month, no credit card required) or on a paid subscription basis ("Subscription"). Paid Subscriptions are billed in advance on a recurring basis ("Billing Cycle"), typically monthly or annually.

At the end of each Billing Cycle, your Subscription will automatically renew under the same conditions unless you cancel it or 1claw cancels it. You may cancel through your account settings or by contacting us at ops@1claw.xyz.

A valid payment method is required for paid Subscriptions. By providing payment information, you authorize 1claw or its payment processor to charge all applicable fees to your payment method. All amounts paid are non-refundable except as expressly provided in these Terms. You are responsible for all applicable taxes.

5. Fee Changes

1claw may, at its sole discretion, modify Subscription fees at any time. Any fee change will take effect at the end of the current Billing Cycle. We will provide reasonable prior notice of changes so you have an opportunity to cancel before the new fees apply. Your continued use of the Service after a fee change constitutes your agreement to the modified fees.

6. Refunds

All amounts paid are generally non-refundable. Refund requests may be considered on a case-by-case basis at the sole discretion of 1claw. To request a refund, contact ops@1claw.xyz.

7. Free Tier

1claw offers a free tier with 1,000 API requests per month. No credit card is required. 1claw reserves the right to modify, limit, or discontinue the free tier at any time with reasonable notice. Continued use of the Service after any such modification constitutes your acceptance of the change.

8. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service to store, distribute, or facilitate access to illegal content or credentials obtained through unauthorized means
  • Attempt to circumvent, reverse-engineer, or compromise any security or encryption mechanism of the Service, including HSM-backed key management
  • Use the Service to deploy AI agents or automated systems that violate the terms of third-party services whose credentials are stored in your vaults
  • Abuse the free tier, including through automated account creation or artificial inflation of usage metrics
  • Interfere with or disrupt the integrity or performance of the Service or its infrastructure
  • Probe, scan, or test the vulnerability of any 1claw system without prior written authorization
  • Use the Service in any manner that could damage, disable, overburden, or impair 1claw servers or networks

9. Your Data and Secrets

"Your Data" means all secrets, credentials, metadata, vault contents, and other data you store or transmit through the Service. You retain all rights to Your Data.

You grant 1claw a limited license to store, process, encrypt, backup, and retrieve Your Data solely for the purpose of providing the Service to you. 1claw will not access, use, or disclose the contents of your secrets except as required to provide the Service, as permitted by you, or as required by law.

You represent and warrant that you have all rights necessary to store Your Data through the Service and that doing so does not violate any applicable law, third-party agreement, or intellectual property right.

10. Security and Encryption

1claw employs Hardware Security Modules (HSM) and envelope encryption with per-secret Data Encryption Keys (DEKs) wrapped by HSM-backed Key Encryption Keys (KEKs). Encryption keys never leave the hardware security module.

While 1claw employs industry-standard security practices, no system can guarantee absolute security. You are responsible for using strong, unique API keys and for promptly revoking or rotating credentials in the event of a suspected compromise. 1claw provides tools to revoke agent access and rotate secrets at any time.

11. AI Agent Usage

1claw is designed for use with AI agents. By registering an agent identity with the Service, you assume full responsibility for that agent's actions, including all secret accesses recorded in the audit log. You are responsible for configuring appropriate policies, scopes, permissions, and expiry conditions for each agent.

Short-lived JWTs issued by the Service expire within minutes. You acknowledge that proper agent key hygiene — including prompt revocation when an agent is decommissioned — is your responsibility.

12. Intellectual Property

The Service and all its contents, including but not limited to software, design, text, graphics, APIs, and documentation, are the property of 1claw and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without prior written permission from 1claw.

These Terms do not grant you any license to use 1claw trademarks, service marks, or logos. The open-source SDK and related repositories are governed by their respective licenses (currently PolyForm Noncommercial 1.0.0 unless otherwise noted).

13. Links to Third-Party Services

The Service may reference or integrate with third-party services (e.g., Supabase, Cloud KMS providers, AI assistant platforms). 1claw has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party service. We encourage you to review the terms and privacy policies of any third-party services you connect to via 1claw.

14. Operational Communications

By creating an account, you agree to receive operational emails including billing notices, security alerts, audit summaries, and service updates. These communications are necessary to provide the Service and cannot be opted out of while your account is active.

15. Termination

You may stop using the Service and close your account at any time by contacting ops@1claw.xyz. You will remain responsible for any outstanding charges through the date of cancellation.

1claw may suspend or terminate your access to the Service if you violate these Terms, engage in activity that poses a security risk to other users, or fail to pay applicable fees. In most cases, 1claw will provide prior notice via email and an opportunity to remedy the issue before termination.

1claw may terminate without prior notice if: (i) you commit a material breach that poses immediate risk to 1claw or other users; (ii) providing notice would create legal liability; or (iii) we are prohibited from notifying you by law. Upon any termination, we will make reasonable efforts to allow you to export your data within the limits of applicable law.

All provisions of these Terms that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

16. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR CONTINUOUS AVAILABILITY. 1CLAW DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 1CLAW, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF REVENUE, OR EXPOSURE OF SECRETS, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL 1CLAW'S AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE FEES PAID BY YOU IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).

18. Indemnification

You agree to indemnify, defend, and hold harmless 1claw and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) Your Data; (c) your agents' use of the Service; (d) your violation of these Terms; or (e) your violation of any third-party rights.

19. Modifications to Terms

1claw reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms at https://1claw.xyz/terms and, where feasible, by sending notice to your registered email address. Your continued use of the Service after the effective date of any modification constitutes your acceptance of the revised Terms.

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which 1claw is incorporated, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction in that territory, and you consent to personal jurisdiction in such courts.
